Terms of Use

The agreement

These Terms of Use are an agreement between you and Midas Media Moguls LLC, which operates the game studio Max Ent Studios ("we", "us", "our"). They cover maxentstudios.com and the games and apps we publish (the "Services"). By using the Services, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Services.

Who can play

• You must be at least 13 years old, or the minimum age in your country, to create an account. Younger players may play our family-friendly games with a parent or guardian's permission.
• MAX HOUSE is for players 18 and older only.
• If you use the Services on behalf of someone else, you confirm you're allowed to accept these terms for them.

Accounts

Keep your login details private and pick a username that isn't offensive or misleading. You're responsible for activity on your account. We may rename, suspend or close accounts that break these terms.

Your license

We give you a personal, limited, non-exclusive, non-transferable and revocable license to play our games for your own non-commercial entertainment. Everything in the Services, including the code, art, characters, music, voices and names, belongs to us or our licensors. You may not copy, modify, resell, reverse engineer or exploit the Services except as the law allows.

You're welcome to stream and post videos of our games, including monetized videos, as long as you don't suggest we sponsor or endorse your channel.

Virtual items and credits

Our games may include virtual coins, credits, items, ranks and other content. These have no monetary value, can't be exchanged for real money or anything of value, and can't be sold or transferred outside the game. We may change or remove virtual items as games evolve.

MAX HOUSE is a social casino that uses play-money credits only. No real-money wagering takes place, and credits can't be cashed out or redeemed for prizes of real-world value. Success in a social casino doesn't mean future success at real-money gambling.

Purchases

Some games may offer optional in-app purchases or subscriptions. They're processed by the platform you buy through (such as Apple's App Store) and are subject to that platform's terms and refund policies. Subscriptions renew automatically until you cancel them in your platform account settings.

Rules of conduct

Trash talk is part of the fun, but keep it about the game. You agree not to:

• Harass, threaten or hate on other players, or share anyone's personal information.
• Cheat, use bots or exploits, or interfere with other players' games or our servers.
• Impersonate others, or create accounts in bulk.
• Use the Services for anything illegal.

Usernames, chat messages and other things you send through the Services must follow these rules. You keep ownership of what you create, and you give us permission to use it as needed to run the Services. If you send us feedback or ideas, we may use them without owing you anything.

Apps from the App Store

If you downloaded one of our apps from Apple's App Store, these extra terms apply:

• These terms are between you and Midas Media Moguls LLC, not Apple. We, not Apple, are responsible for the app and its content.
• Your license is limited to using the app on Apple-branded devices you own or control, as allowed by the App Store's Usage Rules.
• Apple has no obligation to provide maintenance or support for the app. Please contact us for support.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app. To the extent allowed by law, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for handling any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, and intellectual property claims.
• You confirm you are not located in a country subject to a U.S. Government embargo, and you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disclaimers and liability

We work hard on our games, but the Services are provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Services will always be available, error-free or that saved progress will never be lost.

To the fullest extent allowed by law, we won't be liable for indirect, incidental, special, consequential or punitive damages, or lost data or profits. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some places don't allow these limits, so they may not fully apply to you.

You agree to cover our reasonable losses arising from your misuse of the Services or breach of these terms.

Governing law, changes and termination

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Wyoming, unless the law where you live gives you the right to bring a claim locally.

We may update these terms. When we do, we'll change the effective date above, and for significant changes we'll give notice on this site or in our games. You can stop using the Services at any time, and we may suspend or end access for anyone who breaks these terms.
